Welcome to Lumar VPN! These Terms of Use (hereinafter referred to as the "Terms") constitute a legally binding agreement between you (the user) and Ennote Security Inc. (hereinafter referred to as the "Company", "we", "us"). By using the http://lumar-vpn.com website and the Lumar VPN application (collectively, the "Service"), you agree to be bound by these Terms.
1. General Provisions and Age Restrictions
1.1. These Terms govern the provision of access to the Service.
1.2. By using Lumar VPN, you represent and warrant that you are at least 18 years of age and possess the legal capacity to agree to these Terms. If you do not agree with any part of these Terms, you must immediately cease using the Service.
2. Purpose of the Service and "As Is" Basis
2.1. Lumar VPN provides access to a virtual private network (VPN) infrastructure to protect user internet traffic and enhance online privacy and security.
2.2. The Service is provided on an "as is" and "as available" basis. The Company makes no warranties regarding absolute uninterrupted operation, absence of errors, or 100% compatibility with all possible networks or devices worldwide.
3. Access Options and Device Management
3.1. Free Access: Provided to users on the condition of viewing sponsored advertising materials prior to establishing a VPN connection.
3.2. Paid Access (Premium): Provided on a paid subscription basis. Premium access completely disables advertisements and grants access to dedicated high-speed servers.
3.3. Device Limit: One authorized account (including a Premium subscription) may be used on no more than five (5) devices simultaneously. Adding new devices and removing inactive ones is managed by the user independently through the mobile application interface.
4. Authorization and Security
4.1. The Service does not require traditional registration with a password. Authorization is carried out via your Apple ID, Google Account, or by entering an email address.
4.2. The user is solely responsible for maintaining the confidentiality and security of their Apple ID, Google Account, or email account used to access Lumar VPN.
5. Refund Policy and Regional Restrictions
5.1. No Refunds: Because Lumar VPN provides a fully functional free version (supported by ads), the user has ample opportunity to thoroughly test the Service's performance on their device and network prior to making a purchase. Consequently, no refunds are provided for paid Premium subscription periods.
5.2. External Blockages: The Company shall not be held liable for the unavailability of the Service caused by the blocking of VPN protocols, IP addresses, or domains by internet service providers, government regulators, or other third parties in any country. Such external restrictions do not constitute grounds for a refund.
5.3. All issues related to subscription cancellations and refunds for transactions processed through Google Play or the Apple App Store are governed exclusively by the terms of those platforms and must be resolved through their respective customer support services.
6. Personal Responsibility and Prohibited Conduct
6.1. The Company strongly encourages using the Service exclusively for lawful purposes to protect personal data.
6.2. The user bears full personal responsibility for any actions taken while using Lumar VPN.
6.3. It is strictly prohibited to use the Service for fraud, distribution of malware, copyright infringement (piracy), launching DDoS attacks, spamming, or any other activities that violate the laws of your jurisdiction or international law.
6.4. In the event such violations are detected, the Company reserves the right to terminate the user's account immediately, without prior notice and without the right to a refund.
7. Governing Law and Jurisdiction
7.1. These Terms, and any disputes arising out of or in connection with the use of the Service, shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
7.2. All disputes shall be subject to the exclusive jurisdiction of the competent courts of the Province of British Columbia, Canada.
